1. About Kabutar

Kabutar ("the Platform", "we", "us") is a peer-to-peer parcel delivery platform that connects travelers with spare luggage space to people who need to send parcels between cities in India. Kabutar is operated by Kabutar Technologies (contact: kabutar.support@gmail.com).

Kabutar is a technology platform only. We do not physically handle, transport, or take custody of any parcel. All delivery arrangements are made directly between users.

2. Eligibility

• You must be at least 18 years old to use Kabutar.
• You must be a resident of India or be traveling within India.
• You must provide accurate and truthful information during registration.
• You must have a valid Indian mobile number for OTP verification.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at kabutar.support@gmail.com if you suspect unauthorized access to your account.

One person may only maintain one active account. Creating multiple accounts is prohibited and may result in permanent suspension.

4. Traveler Responsibilities

If you post a trip and agree to carry a parcel, you agree to:

• Carry only the items described by the sender at the time of agreement.
• Inspect the parcel at pickup and refuse to carry if it appears suspicious or misrepresented.
• Complete the OTP-verified pickup process before taking possession of the parcel.
• Complete the OTP-verified delivery process and upload photo proof upon delivery.
• Not open, tamper with, or delay delivery of any parcel.
• Report to authorities and Kabutar support if you discover prohibited items.

5. Sender Responsibilities

If you post a parcel request, you agree to:

• Provide accurate descriptions of all items being sent, including weight and contents.
• Ensure the parcel does not contain any prohibited items (see Section 6).
• Be present at the agreed pickup location and time, or arrange an authorized representative.
• Agree on price and terms with the traveler directly before handover.
• Pay the agreed amount to the traveler promptly after delivery.

6. Prohibited Items

• Cash, currency, or negotiable instruments of any kind
• Illegal drugs, narcotics, or controlled substances
• Weapons, ammunition, or explosives of any kind
• Counterfeit goods, pirated media, or trademark-infringing items
• Liquids, flammable, or hazardous materials
• Perishable food items that may spoil in transit
• Pornographic or obscene materials
• Any item banned under Indian law or customs regulations
• Any item that violates the rights of third parties

7. Payments and Fees

Kabutar does not currently process payments between users. Price negotiation and payment happen directly between travelers and senders. Kabutar is not responsible for disputes regarding payment amounts or non-payment.

Kabutar is free to use and does not charge any service fees at this time. This may change in the future with advance notice to users.

8. KYC Verification

Users who submit KYC documents agree that their identity documents will be reviewed by Kabutar administrators. Kabutar reserves the right to approve or reject KYC submissions. Verified status may be revoked if fraudulent documents are discovered. Submitting false identity documents is a serious violation and may be reported to authorities.

9. Ratings and Reviews

Ratings submitted on the platform must be honest and based on actual delivery experiences. Fake ratings, rating manipulation, or harassment via the ratings system is prohibited and may result in account suspension.

10. Limitation of Liability

Kabutar is a facilitating platform and is not a party to any delivery agreement between users. To the maximum extent permitted by applicable Indian law:

• Kabutar is not liable for loss, damage, theft, or delay of any parcel.
• Kabutar is not liable for misrepresentation of parcel contents by senders.
• Kabutar is not liable for personal injury or property damage arising from user interactions.
• Kabutar's total liability in any dispute shall not exceed ₹1,000.

Users agree to hold Kabutar harmless from any claims arising from their use of the platform.

11. Prohibited Conduct

Users must not:

• Use the platform for any unlawful purpose.
• Harass, threaten, or abuse other users.
• Create fake accounts or impersonate others.
• Attempt to circumvent security measures or access systems without authorization.
• Use automated tools, bots, or scripts to interact with the platform.
• Resell or commercialize access to the platform.

12. Termination

Kabutar reserves the right to suspend or permanently terminate any account at any time, for any reason, including but not limited to violation of these Terms. Users may also delete their account by contacting kabutar.support@gmail.com.

13. Changes to Terms

Kabutar may update these Terms at any time. Continued use of the platform after changes are posted constitutes acceptance of the updated Terms. Significant changes will be communicated via the app or email.

14. Governing Law and Disputes

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of Kabutar shall be subject to the exclusive jurisdiction of the courts in Delhi, India. We encourage users to first attempt to resolve disputes by contacting us at kabutar.support@gmail.com.
